HP Nabs EMC’s David Donatelli - But Is He In Breach Of Contract?

Big doings over at Hewlett Packard. 

EMC’s ex-excutive VP David Donatelli - who suddenly resigned two weeks ago from his position as president of EMC’s storage sector - is set to join his once arch rival Hewlett Packard this week.

His new role at HP?

Executive vice president in charge of HP servers, storage and networking.

But if this news wasn’t juicy enough - it gets better.

EMC and Donatelli are now twisted in a heated legal dispute over the resignation. Both have filed lawsuits against each other which involve the terms of a non-compete clause in Donatelli’s employment. At issue: Hewlett Packard - an obvious market competitor; both EMC and HP make and sell storage hardware and software.

So what now?

Well if EMC wins this battle Donatelli will be legally blocked from taking the new position at HP.

If HP wins - well, enough said.

However, given EMC’s track record they may have a shot.  In 2001, EMC won a non-compete lawsuit in Massachusetts against Doron Kempel who was leaving EMC to become CEO of SANgate Systems. He had to wait almost a year before taking up his appointment. Kempel later became chairman and CEO of a deduplication vendor, Diligent, which was acquired by IBM, where he now works.

I give it up to EMC for not letting go of its top execs without a fight. Donatelli is a 22-year EMC veteran with intimate knowledge about EMC’s operations, storage systems, and strategic partners.

Perhaps HP didn’t know what it was getting itself into when it offered the position to Donatelli. Or perhaps it did.

Either way, you can bet storage bloggers - especially our friends at Storage Soup - and the IT community are loving the excitement.
